1. Purpose & Scope

CAGS TOBACCO AND TOBACCO PRODUCTS INDUSTRY AND TRADE JOINT STOCK COMPANY ('CAGS') manufactures and distributes age-restricted tobacco products. This Age Verification Policy explains how CAGS restricts access to its website, products, and services to appropriate, of-age business users, and the responsibilities of our buyers and trading partners.

This policy applies to www.cagsgrp.com and all CAGS digital services, communications, and commercial transactions. It should be read together with our Terms & Conditions, Privacy Policy, and Legal Disclaimer.

2. Legal Framework

CAGS is committed to preventing minors from accessing tobacco products and to supporting lawful, age-restricted trade. This policy reflects:

  • EU Tobacco Products Directive (TPD2 — 2014/40/EU) and national implementing laws in EU member states.
  • UK tobacco legislation, including the Children and Families Act 2014 and related age-of-sale rules.
  • Turkey's tobacco control laws governing the manufacture, sale, and export of tobacco products.
  • Applicable minimum-age laws in every market where CAGS products are imported, distributed, or sold.
  • Turkey's KVKK and the GDPR for the lawful and minimal handling of any age-related personal data.

3. Minimum Age Requirement

CAGS products are strictly intended for adults of legal age only and are sold exclusively through business-to-business (B2B) channels.

  • The minimum age to access this website or engage with CAGS is 18 years. Where a market sets a higher minimum age for tobacco products, that higher age applies.
  • CAGS does not sell directly to individual consumers and does not target individual consumers.
  • This website and CAGS's products are not intended for, or directed at, anyone under 18.

4. Who This Policy Applies To

  • B2B buyers, distributors, wholesalers, and licensed trading partners
  • Authorised representatives acting on behalf of a business buyer
  • Recipients of CAGS marketing and commercial communications

5. Website Age Confirmation

Access to www.cagsgrp.com is subject to age and business-status confirmation:

  • On entry, users are required to confirm that they are at least 18 years of age (or the higher legal age in their market) and are acting in a professional business capacity.
  • Users who cannot make this confirmation must not proceed and must leave the website.
  • An age confirmation does not, by itself, create a commercial relationship — all orders remain subject to the B2B verification in Section 6.

6. B2B Buyer Verification (KYC)

Before accepting any order, CAGS applies Know Your Customer (KYC) and compliance checks. As part of onboarding, a prospective buyer may be required to provide:

  • Proof of business registration and legal status of the company.
  • Evidence that the buyer holds all licences, permits, and approvals required to import, distribute, or sell tobacco products in its market.
  • Confirmation that the authorised representative dealing with CAGS is of legal age and authorised to act for the business.
  • Any further information reasonably required to verify identity, age of sale compliance, and regulatory standing.

CAGS reserves the right to refuse or suspend any order or account where age or licensing requirements cannot be satisfactorily verified.

7. Buyer & Distributor Responsibilities

CAGS sells on a B2B basis only. Our buyers, distributors, and trading partners are solely responsible for downstream age compliance, including:

  • Verifying the age of their own customers and not reselling CAGS products to anyone below the legal minimum age in their market.
  • Implementing robust age-verification at their own point of sale (in-store and online).
  • Complying with all health-warning, labelling, packaging, and age-of-sale laws in their destination market.
  • Not marketing or displaying CAGS products in a way that appeals to, or targets, minors.

Buyers indemnify CAGS against any liability arising from their failure to meet these responsibilities, as set out in our Terms & Conditions.

8. Marketing & Communications

  • CAGS directs all marketing and commercial communications at verified business contacts in relevant professional roles only.
  • CAGS does not market to individual consumers and does not use imagery, themes, or channels designed to appeal to minors.
  • Marketing communications are subject to our Anti-Spam & Marketing Communications Policy and applicable advertising restrictions for tobacco products.

9. Data Protection

Any personal data collected for age or identity verification is processed lawfully, kept to the minimum necessary, and handled in accordance with our Privacy Policy, the GDPR, and KVKK. CAGS does not knowingly collect personal data from anyone under 18.

10. If We Identify a Minor

If CAGS becomes aware that a person under 18 has accessed this website or submitted personal data:

  • We will cease any engagement with that person.
  • We will delete any personal data inadvertently collected from them as soon as reasonably practicable.
  • We will take appropriate steps to prevent recurrence.

Parents or guardians who believe a minor has accessed this website or submitted personal data should contact us immediately at info@cagstobacco.com.

11. Enforcement

CAGS reserves the right to refuse access, decline or cancel orders, suspend or terminate accounts, and report unlawful conduct to the relevant authorities where this policy or applicable age-restriction law is breached.

CAGS reviews this policy at least annually and updates it to reflect changes in applicable law, regulatory guidance, and business operations. The 'Last Updated' date at the top of this page shows when it was last revised.
